Terms of Service

These Terms of Service (“Terms”) govern access to and use of the OPRASAM website, dashboard, APIs, and merchant storefront tools (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service is intended for individuals and businesses operating in Ghana who are at least 18 years old and legally able to enter into a binding agreement.

You are responsible for ensuring that your use of OPRASAM complies with applicable local laws, licensing requirements, and tax obligations for your business.

You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account.

Notify us promptly at hello@oprasam.com if you suspect unauthorized access.

As a merchant using OPRASAM, you agree that you are solely responsible for:

• The accuracy of product listings, prices, and availability
• Fulfilling customer orders placed through your storefront
• Customer communication, refunds, and dispute resolution
• Compliance with consumer protection and food-safety rules that apply to your business
• Content you upload, including product images and descriptions

OPRASAM provides software tools. We are not the seller of your products and we are not a party to transactions between you and your customers.

Your storefront is publicly accessible via your unique store link. You control what products and business information are displayed.

Customer orders submitted through your storefront are transmitted to your dashboard. Unless otherwise stated, OPRASAM does not process end-customer product payments on your behalf in the current version of the Service.

Access to premium dashboard features requires an active subscription or an eligible free trial.

New businesses may start a one-time 14-day free trial where available. Trial eligibility and duration may change. After the trial, continued access requires a paid plan (weekly, monthly, or yearly).

Subscription fees are billed through Paystack. By subscribing, you authorize us and Paystack to charge your selected payment method for recurring fees according to your plan.

Prices, plan features, and billing intervals are shown on our pricing page and may be updated with reasonable notice.

You agree not to:

• Use the Service for unlawful, fraudulent, or deceptive activity
• List prohibited, dangerous, or illegal goods or services
• Attempt to bypass security, access controls, or subscription limits
• Upload malware, spam customers, or abuse the order system
• Impersonate another person or business
• Reverse engineer or scrape the Service in unauthorized ways

We may suspend or terminate accounts involved in abuse, repeated policy violations, chargeback fraud, harassment, or activity that threatens platform stability or other users.

You may stop using the Service at any time. You may cancel a paid subscription according to the process available in your account or through Paystack, and access generally continues until the end of the current billing period unless otherwise stated.

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or create legal or security risk for the platform.

OPRASAM uses Paystack to process merchant subscription payments. Paystack is an independent third-party provider. We do not guarantee uninterrupted payment processing and are not responsible for errors caused by payment networks, banks, or mobile-money providers.

You are responsible for verifying successful payment and subscription status in your dashboard.

We aim to keep OPRASAM available and reliable, but the Service is provided on an “as available” basis during this beta/MVP phase. Maintenance, updates, outages, and third-party service interruptions may occur without prior notice.

We do not guarantee uninterrupted uptime or error-free operation.

OPRASAM and its branding, software, and design elements are owned by us or our licensors. You retain ownership of content you upload, and you grant us a limited license to host and display that content solely to operate the Service.

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, OPRASAM and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the amount you paid to OPRASAM for the Service in the twelve (12) months before the event giving rise to the claim, or GHS 100 if you have not paid fees, whichever is greater.

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Material changes may be communicated through the platform or by email where appropriate.

Continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles. Disputes will be handled in good faith and, where necessary, through appropriate courts or forums in Ghana.
